Supreme Court Upholds EPA Oversight of Natural Gas-, Coal-Fired Carbon Emissions – For Now

The Biden administration may continue to enforce emissions limits on natural gas- and coal-fired power plants, the U.S. Supreme Court ruled Wednesday, denying efforts led by energy trade groups and GOP-led states to block the regulations.

The application for a stay, sought in eight separate cases, was led by West Virginia, et al, v. Environmental Protection Agency, et al., No. 24A96.

The U.S. Environmental Protection Agency (EPA) regulations, enacted in April, strengthen New Source Performance Standards (NSPS) under the Clean Air Act. They require new natural gas-fired combustion turbines to capture most of their carbon dioxide emissions by 2039. Similar controls are required on existing coal-fired, steam-generating units.
